Hitting the Wife Does not Invalidate the Marriage Contract
Question :
Does hitting the wife invalidate the marriage contract?
Answer:
It does not invalidate it, but it is forbidden to hit her without reason. However, if there was a reason, which is fear of disobedience by the wife, then Allah, Most High says:
"As to those women on whose part you see ill conduct, admonish them (first), (next) refuse to share their beds, (and last) beat them (lightly, if it is useful).
The scholars say that hitting means without excessive force, hitting in order to enforce discipline. So if he hit her in these circumstances, then the marriage remains sound and is not invalidated, because she committed its cause, which is disobedience.
