The Ruling on a Muslim Woman Marrying a Disbeliever


Question :

A man married a Muslim woman, then it became apparent that the man was a disbeliever, what is the ruling?


Answer:

If it is confirmed that the aforementioned man was a disbeliever at the time he made the contract and the woman was a Muslim, then the contract will be null and void. This is because it is not permissible. according to the consensus of the Muslims for a disbelieving man to marry a Muslim woman, according to the Words of Allah, Most Glorified:
"And give not (your daughters) in marriage to Al-Mushrikün till they believe (in Allah Alone)."

and the Words of Him, the Almighty, the All-Powerful:
"then if you ascertain that they are true believers send them not hack to the disbelievers. They are not lawful (wives) for the disbelievers nor are the disbelievers lawful (hushands) for them."
